Limited Warranty

Seller warrants products manufactured and sold buy it against defects in material and workmanship arising under normal usage and care for a period of ninety (90) days from the date of original sale. The aforesaid warranty shall extend only to the original Buyer and is not assignable to any other person. For application of product warranty, call or write Seller’s Customer Service for Return Goods Authorization. Seller’s obligation under the aforesaid warranty is limited to repairing, replacing, or issuing credit, at it’s option, for such products or parts which are returned to our factory, freight prepaid, within the warranty period and are found to be defective in materials or workmanship and does not include the cost of furnishing labor in connection with the installation of such repaired or replaced products or parts or the responsibility or cost of transportation. Seller assumes no liability for delay in performing it’s obligations under the aforesaid warranty. Seller assumes no liability for failure in performing it’s obligations thereunder if failure results, directly or indirectly from any cause beyond it’s control, including but not limited to Acts of God, Acts of government, Floods, Fires, Shortages of material, Strikes and other labor difficulties or delays of failure of transportation facilities.

SELLER MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS EXPRESSLY SET FORTH ABOVE WITH RESPECT TO SUCH PRODUCTS OR PARTS THEREFORE, NOR SHALL SELLER HAVE INCURRED ANY OTHER OBLIGATIONS OR LIABILITIES ON ITS PART OR BE LIABLE FOR ANY ANTICIPATED OR LOST PROFITS, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, TIME CHARGES, OR ANY OTHER LOSSES INCURRED IN CONNECTION WITH THE PURCHASE, INSTALLATION, REPLACEMENT OR REPAIR OF SUCH PRODUCTS OR ANY PARTS THEREFORE WHETHER ORIGINAL EQUIPMENT OR INSTALLED AS A REPLACEMENT, COVERED BY THIS WARRANTY OR OTHERWISE; AND SELLER DOES NOT AUTHORIZE ANY PERSON TO ASSUME FOR SELLER ANY OTHER LIABILITY IN CONNECTION WITH THE PRODUCTS OR PARTS. THEREFORE, IN ALL EVENTS, SELLER’S LIABILITY IS LIMITED TO, AND SHALL NOT EXCEED, THE ORIGINAL PRICE PAID.

SELLER’S PRICES ARE BASED ON THE POLICIES STATED HERIN WHICH LIMIT ITS LIABILITY. IF BUYER DESIRES FOR SELLER TO PROVIDE A WARRANTY GREATER THAN THAT WHICH IS STATED ABOVE, THEN THE SELLER WILL ADJUST UPWARDS THE PRICE FOR THE PRODUCTS HEREIN OR ON THE FACE HEREOF TO REFLECT THE ADDITIONAL EXPENSE TO SELLER WHICH SUCH A WARRANTY OBLIGATION COULD CAUSE.

Products showing any of the following typical signs of abuse will not be considered In-Warranty Failure: Damage in shipment; Moisture damage, rust and corrosion caused by detergents and moisture, Dirty products, failure of which was caused by inadequate care and handling; Broken, bent or other damage, caused by heavy impact or improper handling; Alterations, either electrical or mechanical, performed by Buyer for adapting other devices, unless approved by Seller’s Engineering Department; Paint being sprayed on product; Improper application or installation in end product usages; Any failure where commutator wear indicating the motor has been used to the full extent of it’s normal life expectancy, regardless of the date stamped; Evidence of disassembly or attempted repair; Introduction of a foreign object not intended in the designed operation of the product; and, Exceeding the electrical limitations of the product design.
